Welcome to Fantasy Smoke, a trade name of Fantasy Tree LLC, a Florida-based retailer in Pinellas County specializing in smoking pipes, accessories, and related products for legal tobacco accessories and herbal use or as collectible art, committed to premium quality and customer satisfaction. These Terms and Service (“Terms”) govern your use of our website https://thefantasysmoke.com , apps, and services (collectively, the “Service”). By using the Service, you agree to these Terms, our Privacy Policy, Shipping Policy, and Refund Policy (together, the “Agreement”). If you don’t agree, do not use the Service.

Use recommended chargers, store safely, and don’t modify. Dispose at EPA-approved recycling facilities (www.epa.gov/recycle). Keep away from children/pets. Not for nicotine or illegal use.
You must dispose of all products in accordance with local, state, and federal regulations. We are not liable for environmental or other damages resulting from improper disposal.
General Warning: Products aren’t for medical or nicotine use, not FDA-evaluated. Use at your own risk; consult a physician. Don’t use with controlled substances or for toxic inhalation. Check labels for allergens; we’re not liable for reactions.
Customer Assumption Of Risk: By using our products, you assume all risks, including but not limited to personal injury, allergic reactions, health issues, property damage, or any other losses caused by proper or improper use. Fantasy Smoke and Fantasy Tree LLC are not liable for any claims, damages, or losses arising from your use of our products, including failure to follow warnings, instructions, or applicable laws.

10.1 No Insurance Representation: Fantasy Smoke and Fantasy Tree LLC does not provide product liability insurance or coverage for claims related to personal injury, allergic reactions, health issues, property damage, or any other losses arising from product use. You are solely responsible for assessing the suitability of our products for your needs and assume all risks associated with their use.
Suppliers: Suppliers aren’t liable for misuse or errors beyond our control.

11. Resolving Disputes

Arbitration: Except for IP claims, disputes go to binding arbitration in Jacksonville, FL, via AAA Consumer Rules. No class actions. Opt out within 30 days at shop@thefantasysmoke.com. Claims must be filed within 1 year, unless law requires otherwise.
Court: IP disputes go to Jacksonville, FL courts.

12. Advertising
12.1 General Advertising
We advertise only for legal tobacco/herbal use, per FTC (15 U.S.C. § 45), FDA Tobacco Control Act (21 U.S.C. § 387), and Florida laws, avoiding minor-targeted marketing. Customer violations may result in account suspension or termination.
12.2 SMS Marketing
By opting into our SMS marketing program, you agree to receive recurring promotional text messages about Fantasy Smoke’s products and offers. Reply STOP to opt out or HELP for support. Message frequency varies. Message and data rates may apply. We comply with the Telephone Consumer Protection Act (47 U.S.C. § 227). Contact shop@thefantasysmoke.com for assistance.
12.3 Affiliate Program
Fantasy Smoke is not liable for any claims, damages, losses, or legal issues arising from participation, promotion, promo codes or affiliates or actions. Affiliates must comply with all FTC guidelines and applicable laws and all terms. 21+ only. No spam. We reserve the right to terminate any account at our sole discretion. Participation is at your own risk.

13. Uncontrollable Events
We’re not liable for delays from events like natural disasters, cyberattacks, strikes, or supply chain disruptions. We’ll notify you and minimize impacts.

14. Governing Law
Florida, county, and federal laws (e.g., Tobacco 21, export controls, OFAC sanctions) govern these Terms. The English version controls.

15. Entire Agreement
These Terms, Privacy Policy, Shipping Policy, and Refund Policy form the full agreement. No waiver counts unless written.

16. Electronic Consent
You agree to receive agreements, notices, and disclosures electronically, per federal law.

17. Severability and Survival
If a provision is invalid, others remain. Liability, IP, indemnification, and dispute sections survive termination.

18. Assignment and Notices
